SECTION ONE // RENTAL POLICIES

1. Rental Requirements

1a. Drivers must be over the age of 25 years and less than 75 years of age. Drivers must present a current valid driver’s license. International drivers must also produce their passport. Drivers must have a safe driving record and may be subject to a Motor Vehicle License check. Only the drivers listed on this Rental Agreement can operate the vehicle.

1b. Visa, MC, AMEX, Discover are the only accepted credit cards to make a reservation. If someone other than the drivers pays for the rental an addition credit card swipe will have to be made to have one file but will will not be charged. A credit card authorization swipe will be made in the amount of your estimated rental charges. You may be required to authorize a higher amount on your credit card depending on your insurance coverage.

1c. Drivers must demonstrate that they have full insurance coverage in the event that additional overages in the Rental Agreement and declined or that they indeed assume full financial responsibility for all losses and damage to the rental vehicle. In this case an additional credit card authorization may be required.


2. Rental Charges and Supplemental Fees

2a. All rentals are based on a predetermined rate and are subject to sales tax, mileage charges and any additional coverages.

2b. Vintage Mustang Rentals offers a variety of rental coverage including Liability Damage Waiver, Personal Accident and Personal Effects Insurance and Renter Liability Protection at an  additional fee.

2c. Due to the nature of our hourly rental plan we would like you to enjoy every moment in the rental without having to waste time at the pumps. Fuel charges are internally calculated at the market price and are billed as per mileage charges on the Rental Agreement. The market price of gasoline is determined by the neighborhood average . In the event that you find you have to put gas in the car please do so and present your receipt upon return for a credit.


3. Reservations, Cancellations and No-Show Policy

3a. Reservations are on first come first serve basis and they can be requested by email or by telephone. [insert number here] A credit card authorization will be taken at time of the reservation being accepted. An estimate of your total rental fees will be given. The estimate is the anticipated amount of most of your fees. These include estimated taxes, rental fees, and additional coverages. Your mileage use fees will be on the final billing receipt.

3b. We will try to honor any special requests that you have in regard to colors or options on your rental. There are rare circumstances that may prevent us from providing you with the exact car that you have reserved. These situations may include a previous renter not returning the car in time, a mechanical failure or the vehicle is  returned with physical damage. We will make all attempts to supply you with a comparable vehicle subject to availability. In the event of no rental vehicle being available because of any the above, we will offer you a full refund.

3c. Because of the demand for our rental vehicles, Vintage Mustang Rentals requires a cancellation notice of at least 48 hour. Cancellations received less than 48 hours before the reserved rental time are subject to 75% penalty of the rental charges.

3d. Changes to your reservation within 24 hours of your reserved rental time are subject to a $40 change fee.

3e. Reservations that do not show up, "No Shows", will be charged the full rental charges subject to management discretion.

3f. Grace Period. Vintage Mustang Rentals understands that sometimes traffic or other delays out of your control preventing you from returning the rental vehicle on time. An appropriate grace period will be added to the time of your designated return tie before you will be charged for the over time the discretion of management. The length of this grace period will depend upon the circumstances and will be at the directions of the management.


4. Safety

Child safety seats and restraints are not supplied by Vintage Mustang Rentals. California law requires all drivers and passengers to wear seat belts. Only lap belts are supplied as per factory installation. No standing up while the vehicle is in motion.


5. Insurance

The renter is wholly responsible for all the damage and loss to the vehicle even if the cause is unknown or not caused by the renter. The renter should check with their insurance company and credit card company to find out if they have rental car coverage and provide you with a statement if they do. California law does not require renters to purchase additional coverage from rental car agencies but we strongly urge you to look at the additional coverage if you are not covered for these incidents. Vintage Mustang Rentals insurance policy is secondary coverage only. PLEASE INQUIRE.


6. Rental Etiquette and Standard of Care

The renter shall respect the fact that he or she is renting a classic car. We ask that you respect the classic car and it's limitations. Classic cars in general do not have modern technologies that we expect in modern day cars. Please obey the speed limit at all times and please remember when they cars were made the speed limit was 55 mph. We ask that you find reasonable distance and be more aware of traffic around you in order to stop in a safe manner. We ask that you do not eat or drink in the car and smoking or vaping in the car is prohibited. Abnormal or excessive wear and tear that occurred while VMR car was under your care shall be assessed upon rentals return. Acceptable wear and tear is defined by minor issues that during the re cleaning process after a rental return is easily remedied without cost. Any rental returns that require extra cleaning from stains, dirt, etc. will be subject to a minimum $50 cleaning charge.


7. Toll Roads

The renter is responsible for paying all toll fees. For your convenience transponders (electronic payment devices) are already installed in the vehicle  so that you do not have to stop and pay the toll fees. You will be charged at the return of your rental.


8. Telematics Technology

The vehicle may be equipped with telematics technology that allows us to track the vehicle and to obtain data about the vehicles use during your rental.


SECTION TWO // TERMS AND CONDITIONS

1. Parties to the Agreement

The following terms and conditions together with the rental agreement are in whole the agreement between the renter and Vintage Mustang Rentals. The terms, you, your, renter, means the person (s) identified as the driver, any person signing the rental agreement, and any additional authorized driver, and any person to whom charges are billed to by Vintage Mustang Rentals. All persons referred to in this regard are jointly and severally bound by the Rental agreement. Vintage Mustang Rentals means the business and its agents and employees.


2. Condition and Return of Vehicle

2a. You acknowledge that the rental vehicle and other equipment is owned by Vintage Mustang Rentals and are in good condition, unless you notify Vintage Mustang Rentals or their designated representative otherwise at time of pick-up.

2b You will return the rental vehicle to the location as specified in the rental agreement and in the same condition as you received it except for ordinary wear and tear. The vehicle shall be inspected for damage at time of return.

2c. You will return the rental vehicle on time as specified in the rental agreement unless otherwise previously arranged.


3. Prohibited Uses of Rental Vehicle

The use of a cellphone without a hands free device while driving.(All cars are bluetooth equipped and come with hands free capabilities) Driving of the rental car by anyone driving that is not listed as a driver on the Rental Agreement. The use of the vehicle for commercial hire. The use of the vehicle in an unsafe or unlawful manner, including but not limited to  speed tests, reckless driving, violation of the law. The use of the vehicle off road or on any unpaved road. Driving the vehicle without a valid driver’s license or with a license that has been suspended or revoked. Using the vehicle to carry passengers in excess of the number of seat belts provided and to transport children without approved child safety seats, and or restraints. The use of the vehicle propel, push or tow any vehicle or trailer. Driving the vehicle beyond a radius of 50 miles without prior written consent. To leaving the keys in the vehicle. Transporting chemicals (including gasoline), corrosives, explosives or other hazardous materials or pollutants. Subleting or subleasing the vehicle. The use the vehicle in connection with conduct that can be charged as a felony.


4. Cause:
Breach of Rental Agreement

Any prohibited use of the rental vehicle. By anyone who fails to pay rental charges. By anyone who has given Vintage Mustang Rentals false or misleading information. By failing to summon the police to any accident involving personal injury or property damage. By abandoning the rental vehicle. By failing to disclose physical damage to the vehicle while under your care. By violating any term, conditions, Rental Policies as listed in Section 1 and verbal or written agreements of Vintage Mustang Rentals and the renter.


5. Collision, Damage, Repair Costs, Theft and loss damage waiver. Please read carefully!

5a. You accept responsibility for damage to, theft of, vehicle or any part of accessory regardless of fault or negligence of you or any other person or act of god. You shall pay Vintage Mustang Rentals the amount necessary to repair the vehicle. You shall not have a vehicle repaired without permission from Vintage Mustang Rentals. Renters own insurance or credit card company may cover all or part of the renter's financial responsibility for damages or loss to the vehicle. Renter should check to find out about the scope of the renters coverage (s) and what deductible may apply. If vehicle is stolen and not recovered or Vintage Mustang Rentals determines vehicle is salvage, you shall pay Vintage Mustang Rentals the fair market value less any sale proceeds. For purposes of this rental agreement, fair market value shall be the retail value of vehicle directly preceding the loss. Damages for which you are also responsible include but are not limited to : loss of use, administrative fees, diminishment of value, towing, storage or impound fees, and other costs incurred by Vintage Mustang Rentals to recover vehicle and establish damages as the law allows.

5b. Vintage Mustang Rentals will not hold renter responsible for the damage and or loss of use if renter purchases Loss Damage Waiver, except if a provision is violated under the Prohibited Uses Of Rental Vehicles. In the event such a provision is violated, the LDW shall deemed voided. Under such circumstances each renter, singularly and jointly is fully responsible for any damage, repair costs, loss of use and all other related costs and charges.

5c. LDW does not cover loss or damage due to theft or vandalism. If renter purchases LDW, renter remains liable up to the full market value of the vehicle. If the vehicle is not returned to Vintage Mustang Rentals for any reason including an alleged theft, renter is fully responsible for the fair market value of the vehicle to the full extent provided by the law.


6. Mechanical Breakdown or Emergency Roadside Service

In the event of a mechanical breakdown or malfunction, renter shall immediately seek a safe location to stop operation of the vehicle and contact Vintage Mustang Rentals immediately. In the case of fire renter shall call 911 first. Renter will not authorize of attempt any unauthorized repairs to the vehicle. Renter is fully responsible if any unauthorized repairs that are performed and any subsequent damage caused thereby. Vintage Mustang Rentals or their designated representative shall inspect, repair, replace or credit renter in the event the vehicle cannot continue as deemed appropriate by Vintage Mustang Rentals.


7. Vehicle Monitoring

The vehicle may be equipped with telematics technology that allows us to track the vehicle and to obtain data about the vehicles use during your rental. By entering into this Rental Agreement you consent to our use of such telematics during your rental as permitted by law.


8. Property left in the Rental Vehicle

Vintage Mustang Rentals is not liable for loss or damage to any property left in vehicle or transported by renter, whether or not said loss or damage was caused by or related to negligence of Vintage Mustang Rentals or vehicle malfunction. Renter assumes all risk of such loss or damage and waives all claims against Vintage Mustang Rentals arising from such losses.


9. Indemnification from Third Party Claims/Lawsuits

Renter agrees that renter and renter's insurer shall defend and indemnify Vintage Mustang Rentals in connection with any and all injuries, damages, claims, lawsuits, attorney’s fees, costs and expenses arising out of, or related to, the use and/ or operation of the Vehicle. Renter must immediately report to the police all accidents involving any bodily injury or property damage or more than $100. In the event of an accident causing any damage or bodily injury, renter shall notify Vintage Mustang Rentals immediately, fill our Vintage Mustang Rentals' Accident report and set forth in writing a detailed explanation of how the accident happened and identify all witnesses. If this cannot be done in person, renter will do so by phone or mail within 24 hours of the accident. Vintage Mustang Rentals shall not be liable in whole or in part for any indirect, special  or consequential, including without limitation, loss of time, income, lodging, personal expenses, loss of benefits, suffered or incurred by renter or any third person relating to or arising out of the furnishing, performance, or use of the vehicle, including mechanical breakdown or failure to honor a reservation. Vintage Mustang Rentals does not indemnify or insure against any claim for bodily injury or property damage caused to the third party. Renter is primarily liable for such claims under California law. If renter purchases Renter's Liability Protection (RLP) or Supplemental Liability Insurance (SLI), renter has entered into an insurance contract with an insurance company which may not be a California admitted carrier and is unaffiliated with Vintage Mustang Rentals. If such insurance company should fail or refuse to honor its insurance obligations, it is not the responsibility of Vintage Mustang Rentals. Renters Liability Protection (RLP) provides, subject to limitations and exclusions set forth in the insurance contract, coverage for liability in vehicular accidents caused by an authorized driver with the vehicle up to the limits of $15,000 for single bodily injury, $30,000 for multiple bodily injuries, and $5,000 for property damage. Neither renter's Liability Protection (RLP), nor Supplemental Liability Insurance(SLI), if purchased, insures renters for property damage or loss caused to the Vehicle, unless Loss Damage Waiver (LDW) applies. Renters covenants and agrees renter will hold harmless and indemnify Vintage Mustang Rentals, the vehicle owner, lessor, and lien-holder from any and all claims, demands, causes of action, attorney fees, costs or expense of any kind that relate to, or arise from, any alleged negligent use or operation of the vehicle during the terms of the rental.


10. Notice About Your Financial Responsibility and Optional Damage Waiver

Renter is responsible for all damage or loss to the Vehicle, even if caused by someone else or the cause is unknown. Renter is responsible for the cost of the repairs (up to its full value), loss of use, diminished value, towing, storage and impound fees. The renter's personal auto insurance, or the credit card used to pay for the rental transaction, may cover all or part of renter's financial responsibility for the vehicle. Renter should check with the renter's insurance company, or credit card issuer, to find out about the coverage and applicable deductible, if any, for which renter may be liable. If a credit card was used that provides coverage for potential liability, renter should check with the card issuer to determine if the renter's personal insurance coverage limits must first be exhausted before the credit card coverage applies. Vintage Mustang Rentals will not hold you responsible for damage, repair costs, or loss of use of the Vehicle if Loss Damage Waiver (LDW) is purchased. Caution: Loss Damage Waiver (LDW) will be voided in the event any of the violations specified in Prohibited Uses of Rental Vehicle. Loss Damage Waiver (LDW) does not protect from liability due to theft or vandalism. Optional Loss Damage Waiver is Pricing Per Day
